While running on an icy sidewalk in front of your neighbor's house, you fall and break your leg. Would you sue your neighbor?

I can't even imagine running, much less on ice. Not my neighbor's fault if I am that careless.

Because of a genetic bone condition, I'm not likely to be running on an icy sidewalk. I avoid walking on icy sidewalks. If for some reason I had to cross my neighbors treacherous footing and fell, my bones--and the rest of my body--have adequate medical insurance. Since a broken leg would take me three years to heal, I'd be quite resentful. Whether or not I sued would depend on whether or not the neighbor habitually neglected the side walk; the neighbor's behavior creating or preventing other crises and whether the neighbor had expressed any personal remorse for the icy conditions. Still, I'd recognize that I was the one who chose to subject my legs to the danger.

No. My broken leg would be my own fault for running on the ice. I caused the accident by taking an unnecessary risk. I could have walked on the icy sidewalk with care or I could have run on my treadmill in my basement where it is nice and warm and not at all slippery.

As long as I received proper medical care and didn't need to have extensive, long term attention, I think I'd just take care of it on my own. If I had no insurance, I'd feel compelled to make them pay it.

Once again, this is an attempt to put in black and white a question that has lots of shades of gray. If it was generally icy out, then I shouldn't have been running, so it would be my own fault, and I probably wouldn't sue. On the other hand, if all the other sidewalks were clear and my neighbor had been negligent about clearing his, then I might sue. Especially if there was a pattern of negligence.

Uh, no. How stupid am I to be running that fast on ice? I mean, I have a glass of milk every day, plus additional calcium in my vitamin supplements, plus whatever calcium I get from cheese and chocolate and stuff. This is pretty much what I've been doing my whole life, and it is HARD to break my bones. I've never done it. So it would be very, very difficult for me to run fast enough to create enough force to stress my leg out to the point of breaking. Granted, the ice could speed me up, but it probably wouldn't be able to do that for long before I fell. Besides, how do I break my leg instead of, say, my wrist? Does it get caught on something and twist? Anyway, no, I would not sue my neighbor. If I'm going to sue someone for my being a dork, it ought to be me.
